Important: If Schembri calls you, don't make a decision on the phone - it could be considered a verbal (binding) contract. Tell them you need more time or you're considering your options.
Even if you verbally (hell, even if you agree in writing) to give up something that's protected as yours under the Landlord-Tenant Act or related legislation, it's still yours. That part of the agreement is simply void.
Example: clauses in a lease requiring you to sign a new 12-month lease at the end of your leased occupancy in order to continue occupancy. Even if you sign the agreement, your landlord can't legally enforce it.
I went to see the building today. I'm outraged. It must have been obvious well in advance that they won't make the deadline. They should have informed us a few weeks in advance.
Schembri property management has acted in a most unprofessional manner.
P.S. if you're wondering what I saw, here it is: The building is far, far from completion. I estimate that it would take at least 2-3 weeks to finish it, have it inspected, and furnish it.
Let's not fool ourselves here, we are looking at an October move in date at the earliest.
Contract law is far from black and white. The session was aimed to empower students and educate them on their rights as a tenant. There is no one, right answer. You were given legal guidance on how to approach this difficult situation and ultimately, it is up to you to weigh the multiple options that were discussed at the session.
I thought the session was good. Gave me the information I needed. I was worried that I would have the option of canceling my lease, but it seems I'm good to try that option. I sent my lease cancellation notice and have starting to work on my application to the landlord and tenant board.
At least they're putting us in hotels and taking some responsibility. My other roommate transferred their lease to one of their other buildings. Shitty situation but I'm fairly impressed with how the mgmt is handling it

Disappointed by the session...basically your rights are wishy washy and everything is arguable on technicality.

Delete4, well... yeah. That's why we have court systems.

DeleteHow are people letting this happen? If I was in this situation I'd demand my money back and a place of accommodation
ReplyDeleteDemand away. Doesn't mean you'll get a dime. I guess good for you for being righteous, I'm sure no one else thought of demanding things.
